apexx Veterinary Equipment (“apexx”) warrants to the original purchaser of its Veterinary products and components (except for components not warranted under “Exclusions” section below) to be free from defects in material and workmanship when used in accordance with manufacturer’s instructions and under normal use and service. apexx’s obligation under this warranty is limited to the repair or replacement, at apexx’s option, of the parts or the products the defects of which are reported to apexx within the applicable warranty period and which, upon examination by apexx, prove to be defective. Repairs are made on an FOB repair depot basis.
Authorization for warranty service can be obtained by calling apexx Veterinary Equipment. Warranty service authorization must be obtained prior to sending in equipment. It is the retail purchaser’s obligation to arrange for delivery of product to apexx Veterinary Equipment at retail purchaser’s expense.
This warranty does not cover and apexx shall not be liable for the following: (1) repairs and replacements required because of customer misuse, abuse, neglect, negligence, alteration, accident, freight damage, or tampering; (2) products which are not installed, used, and properly cleaned as required in the “Operators Manual” or “User Manual” applicable for the product; (3) matching of color or texture except to commercially acceptable standards; (4) changes in color caused by natural or artificial light; (5) products considered to be of a consumable nature including but not limited to paper, light bulbs and batteries; (6) accessories or parts not from the original manufacturer; (7) custom manufactured products; (8) damage caused by animals; (9) charges by anyone (including apexx’s Authorized Distributors) for adjustments, repairs, replacement parts, installation, or other work performed upon or in connection with such products which is not expressly authorized in writing in advance by apexx.
apexx’s only obligation under this warranty is the repair or replacement of defective parts. apexx shall not be liable for any direct, special, indirect, incidental, exemplary or consequential damages or delay including, but not limited to, damages for loss of profits or loss of use.
NO PERSON OR FIRM IS AUTHORIZED TO CREATE FOR APEXX ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH THE PRODUCTS. THIS WARRANTY IS APEXX’S ONLY WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. APEXX MAKES NO IMPLIED WARRANTIES OF ANY KIND INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. THIS WARRANTY IS LIMITED TO THE REPAIR OR REPLACEMENT OF DEFECTIVE PARTS.
